1. Introduction
This Privacy Policy explains how eye2eye.nyc collects, uses, discloses, and protects personal information when you visit or buy from our online store at eye2eye.nyc (the "Site"). The Site is operated by [Operating company name and U.S. address — to be added] (the "Company", "we", "us", or "our"), the company responsible for eye2eye.nyc. To run the Site, we work with GoHub, an independent third-party optical-commerce platform that powers our catalog, optical ordering, and connection to certified laboratories; GoHub processes personal information for us as our service provider. The Company is the business responsible for the personal information described in this Policy.
In this Policy, "personal information" means information that identifies, relates to, or could reasonably be linked with you or your household. This Policy applies to the Site. It does not cover:
- The separate practices of third parties whose services you may use through the Site, including Glasses-on (Virtual Try-On, a provider engaged by GoHub) and Visibly (online vision tests / "find my prescription," also engaged by GoHub, where offered). Those providers handle certain information under their own privacy notices. Our Virtual Try-On & Biometric Notice describes the Virtual Try-On experience in more detail.

2. A note on health information, prescriptions, and HIPAA
eye2eye.nyc is an eyewear retailer. We are not a healthcare provider, and we do not operate as a "covered entity" or "business associate" under the U.S. Health Insurance Portability and Accountability Act (HIPAA). We do not provide eye examinations and do not maintain medical or clinical records.
Where you provide a prescription so we can make your eyewear, that prescription information is used only to verify and fulfil your order and is transmitted through the GoHub platform to a certified dispensing laboratory to produce your Products. We do not retain it as a clinical or medical record, and we do not use prescription information for advertising. Where the Site offers an online vision test or "find my prescription" service, that service is provided by Visibly, a telehealth provider engaged by GoHub, under its own privacy notice and clinical processes; any eye-exam data and resulting prescription are handled by Visibly, not stored by eye2eye.nyc as health records. We handle the limited vision-related information we do receive in accordance with applicable consumer-health-data and privacy laws (see Sections 8 and 13).
3. Information we collect
3.1 Information you provide

3.3 Virtual Try-On information
If you use Virtual Try-On, a live image of your face is processed by our provider Glasses-on to render Products on your face. As described in Section 8 and in our Virtual Try-On & Biometric Notice, this processing happens only in the moment, is used only to create the try-on visualisation, is not used to identify you, and is not stored by us for that purpose.
3.4 Information from third parties
We may receive information from payment processors (e.g., payment confirmation and fraud signals), shipping carriers (e.g., delivery status), advertising and analytics partners (e.g., campaign and audience data), and fraud-prevention services.
We do not seek to collect Social Security numbers, government-ID numbers, financial-account credentials, precise geolocation, or information about your race, religion, sexual orientation, or health beyond the limited vision-related information needed to fulfil eyewear orders. Please do not send us sensitive information we do not request.
4. How we use personal information
We use personal information to:
- Operate the Site and the GoHub-powered catalog and checkout;
- Process, verify, fabricate, fulfil, and deliver your orders, including verifying prescriptions through certified laboratories;
- Provide Virtual Try-On and other features you choose to use;
- Provide customer service, process returns, exchanges, and warranty claims;
- Detect, prevent, and investigate fraud, abuse, and security incidents;
- Personalise your experience and recommend Products;
- Send transactional messages (order confirmations, shipping updates) and, with your consent where required, marketing messages;
- Measure and improve the Site, our Products, and our advertising;
- Comply with legal obligations and enforce our Terms; and
- Establish, exercise, or defend legal claims.
5. Cookies, pixels, and tracking
We use cookies and similar technologies for essential functions, performance and analytics, functionality, and targeting and advertising. We use third-party advertising and analytics tools — which may include Meta (Facebook/Instagram), Google, TikTok, and similar platforms — that set cookies or receive identifiers and activity from your device to deliver and measure advertising and build audiences. Where this is a "sale" or "sharing" of personal information under U.S. state laws, you can opt out (see Sections 6 and 13 and our Do Not Sell or Share page). 6. How we share personal information
We share personal information with the following categories of recipients, each of which is a third party that processes it for us or that you choose to use:

We require service providers to use personal information only to provide their services to us, to keep it confidential and secure, and to delete or return it when our relationship ends.
7. "Sale" and "sharing" of personal information
We do not sell your personal information for money. However, our use of third-party advertising cookies and pixels may be considered a "sale" or "sharing" of personal information for cross-context behavioral advertising under California and other U.S. state laws. The categories involved are identifiers, internet/device activity, and inferences, shared with advertising platforms such as Meta, Google, and TikTok.
You have the right to opt out. You can: use the "Do Not Sell or Share My Personal Information" link in the footer; adjust your cookie preferences to turn off Targeting & Marketing; or enable Global Privacy Control in a supported browser, which we honour as an opt-out. We do not knowingly sell or share the personal information of anyone under 18.
8. Biometric and Virtual Try-On information
Our Virtual Try-On feature is provided by Glasses-on, a third-party provider engaged by GoHub. When you use it, your device camera captures a live image of your face, which is processed to detect facial landmarks (such as the position of your eyes, nose, and ears) so that frames can be sized and overlaid on your face on screen.
- This processing occurs in the moment, to render the try-on only.
- The facial-geometry data is not used to identify you and is not stored by us for identification or any other purpose after the try-on session.
- We obtain your consent before the feature is activated, through the consent screen described in our Virtual Try-On & Biometric Notice.
To the extent this data is a "biometric identifier," "biometric information," or "consumer health data" under laws such as the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act, the Washington My Health My Data Act, or similar laws, we handle it consistently with those laws and our Virtual Try-On & Biometric Notice, which is incorporated into this Policy.
9. How long we keep personal information
We keep personal information only as long as necessary for the purposes described in this Policy, including to provide the Site and your orders, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. Order and transaction records are typically retained for the period required by tax and consumer-protection law. Virtual Try-On facial-geometry data is not retained after the session, as described in Section 8. When personal information is no longer needed, we securely delete or de-identify it.
10. Security
We use technical and organisational measures designed to protect personal information, including encryption in transit, access controls, and secure payment processing through our payment providers. No method of transmission or storage is completely secure. If you believe your account or information has been compromised, contact us at privacy@eye2eye.nyc.
11. Your privacy rights
Depending on where you live, you may have some or all of these rights:
- Know / access the categories and specific pieces of personal information we have collected, the sources, purposes, and the categories of recipients;
- Delete personal information we hold about you, subject to exceptions;
- Correct inaccurate personal information;
- Portability — receive a copy of certain information in a portable format;
- Opt out of "sale" or "sharing" of personal information and of targeted advertising;
- Limit the use of sensitive personal information (we do not use sensitive personal information to infer characteristics);
- Opt out of profiling that produces legal or similarly significant effects (we do not engage in such profiling);
- Appeal a denial of a request, where applicable; and
- Non-discrimination — we will not deny service, charge a different price, or provide a different quality of service because you exercised a right.
12. How to exercise your rights
To make a request, email privacy@eye2eye.nyc with the nature of your request, or use the "Do Not Sell or Share My Personal Information" link in the footer for opt-out requests. We may need to verify your identity before responding, and we may ask for information to do so. You may use an authorised agent to submit a request on your behalf; we will require proof of authorisation. We will respond within the timeframes required by applicable law (generally 45 days for U.S. state requests, with one permitted extension). We honour Global Privacy Control signals as opt-out requests for sale/sharing and targeted advertising.
13. U.S. state privacy notices
13.1 California
This section supplements the Policy for California residents under the California Consumer Privacy Act, as amended (the "CCPA").
Categories of personal information collected in the past 12 months: identifiers; customer-records information (Cal. Civ. Code § 1798.80(e)); commercial information; internet/electronic activity; approximate geolocation; visual information (a Virtual Try-On image, processed transiently as described in Section 8); and inferences. We describe sources, purposes, and recipients in Sections 3, 4, and 6.
Sensitive personal information. We do not use or disclose sensitive personal information for purposes that would trigger the right to limit under the CCPA. To the extent Virtual Try-On data is treated as sensitive, it is used only to provide the try-on you request and is not stored (Section 8).
Sale/sharing. We do not sell personal information for money. We "share" personal information for cross-context behavioral advertising as described in Section 7, and you may opt out.
Your California rights: know/access, delete, correct, opt out of sale/sharing, limit sensitive personal information (as applicable), and non-discrimination. To exercise them, see Section 12.
Shine the Light. California Civil Code § 1798.83 lets California residents request information about disclosures to third parties for those parties' direct-marketing purposes. We do not disclose personal information to third parties for their own direct marketing. You may contact privacy@eye2eye.nyc with questions.
13.2 Other U.S. states
Residents of states with comprehensive privacy laws — including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others as their laws take effect — may have rights to access, correct, delete, obtain a portable copy of, and opt out of the sale of personal data and of targeted advertising and certain profiling, and to appeal a denied request. To exercise these rights, email privacy@eye2eye.nyc or use the "Do Not Sell or Share My Personal Information" link. We honour Global Privacy Control as an opt-out signal.
13.3 Consumer health data
Some states (such as Washington and Nevada) regulate "consumer health data." We limit our collection and use of any vision-related information to fulfilling your eyewear orders and providing features you request, do not sell such data, and obtain consent where required (including for Virtual Try-On, per Section 8 and the Virtual Try-On & Biometric Notice). Online vision tests, where offered, are provided by Visibly (engaged by GoHub) under its own notice.
14. Children
The Site is intended for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, contact privacy@eye2eye.nyc and we will delete it.
15. Do Not Track
Some browsers send "Do Not Track" signals. There is no common industry standard for responding to them, so we do not respond to Do Not Track. We do honour the Global Privacy Control (GPC) signal as an opt-out of sale/sharing and targeted advertising.
16. Third-party links and services
The Site may link to or integrate third-party websites and services, including Glasses-on, Visibly, payment processors, and carriers. We are not responsible for their privacy practices. Review their notices before providing information to them.
17. Changes to this Policy
We may update this Policy from time to time. The "Last updated" date shows when it last changed. Material changes will be posted on the Site and, where required, we will provide additional notice.
