Terms of Sale

1. Scope
These Terms of Sale govern your purchase of Products from eye2eye.nyc and are part of, and incorporate, our Terms & Conditions. Capitalised terms used but not defined here have the meaning given in the Terms & Conditions. If there is a conflict between these Terms of Sale and the Terms & Conditions with respect to a purchase, these Terms of Sale control for that purchase.
2. Placing an order; order acceptance
When you place an order, you are making an offer to purchase the Products in your cart, subject to these Terms of Sale. Each Product in an order is treated as a separate offer. Our acknowledgement of your order (for example, an automated confirmation email) confirms that we received your order; it is not acceptance of it. A contract of sale is formed only when we accept your order, which we do when we ship the Product or notify you that it has been accepted.
We may, at our discretion, decline or cancel all or part of an order, including after acknowledgement, for reasons that include: the Product is unavailable or out of stock; we cannot verify your information, payment, or prescription; we suspect fraud or unauthorised payment; we believe the order is for resale or exceeds purchase limits; there was a pricing or description error; the shipping address is undeliverable; or we cannot lawfully supply the order. If we cancel an order you have already paid for, we will refund the amount charged for the cancelled items.
3. Prescription Eyewear — verification and your responsibility
For orders that include Prescription Eyewear:
- You must provide a valid, current, unexpired prescription from a licensed eye-care professional, generally issued within the last 24 months (or as required by applicable law), and you are responsible for the accuracy of all values and measurements you submit, including pupillary distance.
- You represent that the prescription is yours and that you are not registered blind or partially sighted in a manner that makes self-ordering inappropriate.
- Your order is subject to receipt and verification of your prescription. We, GoHub, or the dispensing laboratory may verify the prescription with the issuing professional, request confirmation of measurements, require a copy of a current written prescription, or decline the order if it cannot be verified.
- If the Site offers an online vision test or "find my prescription" service, that service is provided by Visibly, a telehealth provider engaged by GoHub; any prescription it generates is issued through Visibly's process, not by eye2eye.nyc.
- We are not responsible for Products that do not meet your needs because the prescription or measurements you provided were inaccurate, incomplete, or expired. Remedies for our fabrication errors versus customer-supplied prescription errors are addressed in our Returns & Refunds Policy and Warranty.
4. Pricing, currency, and errors
All prices are in U.S. dollars (USD) and exclude shipping and taxes unless stated otherwise. We try to ensure prices are accurate, but errors can occur. If we discover that a Product was listed at an incorrect price, we may, before shipping, contact you to ask whether you wish to proceed at the correct price or cancel and refund the order; if we cannot reach you, we may cancel the affected items and refund any amount paid. A refund of the amount paid is your sole and exclusive remedy for a pricing error.
5. Taxes
Prices exclude sales and use taxes unless stated. We will charge applicable taxes based on your shipping destination and applicable law, calculated at checkout. You are responsible for any taxes, duties, or fees imposed on your purchase.
6. Promotions and discount codes
Promotions, coupons, and discount codes are subject to their stated terms, cannot be combined unless we say so, have no cash value, apply only while the promotion is active, and may be modified or withdrawn at any time. We may refuse or reverse a discount that we reasonably believe was obtained or used in error, in bad faith, or in violation of its terms.
7. Payment
You authorise us (and our payment processors) to charge your payment method for the order total, including Products, shipping, and taxes. We may authorise your payment method when you place the order and charge it when we accept or ship the order. If an order ships in multiple parts, we may charge for each part as it ships. You represent that you are authorised to use the payment method you provide.
8. Made-to-order Products and fabrication time
Prescription Eyewear and certain lenses, tints, and customisations are made to order through GoHub's certified laboratories specifically for you. These Products are produced after your order and prescription are verified, and they require fabrication time in addition to shipping time. Estimated processing and delivery times are shown at checkout or on our Shipping Policy and are estimates only, not guarantees. Because made-to-order Products are customised to your prescription or specifications, they are subject to the returns exclusions in our Returns & Refunds Policy.
9. Shipping, title, and risk of loss
Shipping methods, costs, and estimated timeframes are described in our Shipping Policy. All purchases are made under a shipment contract: title and risk of loss for the Products pass to you when we deliver them to the carrier. Delivery dates are estimates and are not guaranteed. You are responsible for providing an accurate, deliverable shipping address.
10. Returns, exchanges, and warranty
Your options to return or exchange Products, and any limited warranty we provide, are described in our Returns & Refunds Policy and our Warranty. Please review them before ordering, as certain made-to-order and prescription items are non-returnable except where they are defective or where required by law.
11. Cancelling or changing an order
Because Products may enter fabrication or shipping quickly, we cannot guarantee that we can change or cancel an order after it is placed. Contact us as soon as possible at support@eye2eye.nyc and we will try to help. Once a made-to-order Product has entered fabrication, it generally cannot be cancelled.
12. Limitation of liability for purchases
To the fullest extent permitted by law, our liability arising out of or relating to any Product or purchase is limited as set out in the Terms & Conditions, and, except for any express remedy stated in our Returns & Refunds Policy or Warranty (or any remedy that cannot be excluded under applicable law), a refund or replacement of the affected Product is your sole and exclusive remedy.
13. Governing law and disputes
These Terms of Sale are governed by, and disputes are resolved under, the governing-law and dispute-resolution provisions of our Terms & Conditions (including binding individual arbitration and the class-action waiver, and New York governing law).
