Virtual Try-On & Biometric Notice

1. About this notice

This notice explains how the Virtual Try-On ("VTO") feature on eye2eye.nyc works, what information it processes, and your choices. It supplements our Privacy Policy and is incorporated into it. Virtual Try-On is provided by Glasses-on, a third-party provider engaged by GoHub (the independent third-party platform we work with to run the Site), and made available to you through the GoHub platform. By using Virtual Try-On, you agree to this notice.

2. How Virtual Try-On works

Virtual Try-On lets you see how frames and sunglasses look on your face. When you choose to use it, your device's camera captures a live image of your face (or you may upload a photo). Software then detects facial landmarks — points such as the position of your eyes, nose bridge, and ears — to measure the geometry needed to size frames and overlay the selected Product onto your face on screen in real time.

3. What is processed

To provide Virtual Try-On, the feature processes a live camera image (or a photo you choose to upload) and derives facial-geometry measurements (the relative position of facial landmarks) needed to fit and display frames. To the extent this facial-geometry data is considered a "biometric identifier," "biometric information," or "consumer health data" under applicable law, we treat it accordingly and as described below.

4. Purpose — and what we do NOT do

Purpose. The image and facial-geometry data are used only to provide the Virtual Try-On visualisation you request — to size and display frames on your face — and to let the feature function while you use it.
In the moment only. Processing happens in real time, during your try-on session, on your device or transiently through the Glasses-on service.
No storage. Neither we, GoHub, nor Glasses-on store your facial-geometry data or camera image after your try-on session for that purpose. The data is discarded when the session ends. If you choose to save a try-on photo to your account, only that photo is saved, at your request, and you can delete it at any time.
No identification. The facial-geometry data is never used to identify you or anyone else, and is not used for security, surveillance, or to build a faceprint database.
No sale; no advertising. We do not sell your facial-geometry data or camera image, and we do not use them for advertising or to train unrelated models.

5. Your consent

Virtual Try-On is entirely optional. Before the feature activates your camera or begins processing, we show you a consent screen summarising this notice and ask you to agree. The feature will not turn on your camera or process any image unless you give your consent. If you do not agree, simply decline or close the consent screen and do not use Virtual Try-On; you can still browse and buy without it. You may stop using Virtual Try-On at any time by closing the feature.

6. Your rights under biometric and health-privacy laws

Some laws give you specific rights regarding biometric and health-related data, including the Illinois Biometric Information Privacy Act (740 ILCS 14/1 et seq.), the Texas Capture or Use of Biometric Identifier Act (Tex. Bus. & Com. Code § 503.001), the Washington My Health My Data Act, and similar state laws. Consistent with these laws, we obtain your consent before Virtual Try-On processes any image, we do not retain facial-geometry data after your session, and we do not sell it or use it to identify you. 7. Children

Virtual Try-On and the Site are intended for adults 18 and older. We do not knowingly collect biometric or facial data from anyone under 18.

8. Changes to this notice

We may update this notice from time to time. The "Last updated" date shows when it last changed, and we will obtain renewed consent where required.

Your facial-geometry data and camera image are not stored after your session and are never used to identify you.
We do not sell this data or use it for advertising.
